Q3. I was working at my job when a delivery man came in. He dropped a package on my foot, crushing it. I was in the hospital for over a week and had two surgeries. I’ve been recovering at home now for over a month. My medical bills and wages have been paid by workers compensation. However, I’m not being compensated for my constant pain and sleepless nights, not to mention the disruption to my whole family. Is there anything else I can do?

A3. Workers compensation does not pay for your pain, suffering, and disruption to your (and your family’s) life. It does not pay for your inability to do your usual activities with your loved ones and friends.

If you were injured on the job by someone else’s negligence you may be able to make a claim for that negligence. You may be able to recover for all the kinds of things that workers compensation does not compensate you for.

It may not be obvious that you can make a claim against another party. In this particular example, there was a delivery man. If your injury was instead caused by a defective product in the workplace (chair, bookcase, machine, etc.), then you could bring a claim against that product’s manufacturer.
